Advertising Services Agreement

The Allied Health Hub is operated by NEWCASTLE CREATIVE CO. PTY LTD (ABN 65 003 124 114).

1. About this Agreement

This Agreement governs paid advertising services supplied by The Allied Health Hub, including fixed-price advertising packages, campaign management, promotional activity, advertising top-ups and related reporting.

2. Definitions

Advertising Client means the person, business, clinic, practice, provider, organisation or customer purchasing advertising services from The Allied Health Hub.

Advertising Package means the fixed-price advertising service purchased by the Advertising Client.

Advertising Allocation means the advertising activity, media placement or campaign funding The Allied Health Hub chooses to deploy as part of the Advertising Package. It is not a separate client-held media balance.

3. Nature of the service

Advertising Packages are fixed-price service packages. The Advertising Client does not purchase or hold a separate advertising account, media account, ad-spend balance, prepaid media wallet or unused spend entitlement.

4. TAHH acts as principal

The Allied Health Hub acts as principal in delivering Advertising Packages. Campaigns may be created, managed and delivered through advertising accounts, pages, pixels, tags, tracking systems, audiences, infrastructure and reporting tools owned or controlled by The Allied Health Hub.

5. Advertising Client responsibilities

The Advertising Client is responsible for ensuring all information, approvals, claims, offers, practitioner details, professional registrations, memberships, locations, prices, testimonials, images, logos, landing page content and other campaign materials supplied to The Allied Health Hub are accurate, complete, lawful, current and not misleading.

6. Approval before campaign launch

The Allied Health Hub may require the Advertising Client to review and approve initial campaign materials before a campaign goes live. By approving campaign materials, the Advertising Client confirms they are accurate, lawful, current, authorised and suitable for advertising.

7. Routine campaign optimisation

After approval or launch, The Allied Health Hub may make routine campaign adjustments without seeking separate approval for every edit, including changes to headlines, descriptions, sitelinks, callouts, keywords, targeting, placements, budgets, creative variations, campaign structure or reporting settings, provided those changes are materially consistent with the approved campaign direction.

8. No performance guarantee

The Allied Health Hub does not guarantee leads, bookings, enquiries, conversions, clicks, impressions, ranking, audience growth, revenue, profit, return on investment, cost per acquisition or any other commercial outcome.

9. Channel choice and allocation

The Allied Health Hub may choose, change, pause, rebalance or move advertising activity between channels, campaigns, audiences, placements or formats at its discretion.

The Advertising Client is not entitled to require a particular management split, ad-spend split, channel split or allocation split unless expressly agreed in writing. The Allied Health Hub is not required to disclose internal management, margin, labour, media allocation or advertising allocation splits unless required by law or expressly agreed.

10. Top-ups

A top-up is additional advertising allocation only. It does not automatically extend the management window, add strategy time, create a new package, include new creative production or change the original package scope unless agreed in writing.

11. Third-party advertising platforms

Campaigns may depend on Google, Meta or other third-party platforms. The Allied Health Hub is not responsible for platform policy changes, review delays, rejected ads, restrictions, suspensions, outages, tracking changes, attribution changes or other third-party actions.

12. Shared account acknowledgement

Advertising may be delivered through shared advertising infrastructure owned or controlled by The Allied Health Hub.

A suspension, limitation or restriction affecting The Allied Health Hub advertising infrastructure does not automatically entitle any Advertising Client to compensation, refund, credit, extension or other remedy, even if the Advertising Client did not directly cause the issue.

Where The Allied Health Hub considers it appropriate, it may take reasonable steps to restore, replace, rework, reschedule or adjust affected campaign activity. Any credit, extension, refund or other remedy is at The Allied Health Hub discretion, except where required by law.

13. Client-caused restrictions

If an advertising restriction, limitation, suspension, disapproval, claim, complaint, regulatory issue, platform issue or other adverse event is caused or contributed to by the Advertising Client business, services, claims, offer, materials, approvals, omissions, conduct or instructions, the Advertising Client is not entitled to a refund except where required by law and indemnifies The Allied Health Hub for resulting losses or costs.

14. Compliance review and campaign pauses

The Allied Health Hub may refuse, edit, pause, remove, withdraw or decline to run any campaign, ad, claim, offer, landing page or material it considers unlawful, misleading, non-compliant, high-risk, unsuitable or harmful.

15. Landing pages and hand-offs

The Allied Health Hub is not responsible for the Advertising Client phone handling, inbox management, booking systems, CRM, website, third-party tools, clinical intake, sales process, follow-up speed, appointment availability or user journey after a person leaves infrastructure controlled by The Allied Health Hub.

16. Reporting and attribution

Reporting may be based on available advertising platform, analytics, tracking or campaign data. Data may be estimated, modelled, delayed, incomplete or different from the Advertising Client own records.

17. Cancellation and refunds

Once campaign work has commenced, Advertising Package fees are generally non-refundable except where required by law or expressly approved by The Allied Health Hub.

18. Liability

To the maximum extent permitted by law, The Allied Health Hub is not liable for indirect loss, consequential loss, loss of profit, loss of revenue, loss of opportunity, loss of goodwill, business interruption, third-party platform action, regulatory action arising from Advertising Client materials or failure to achieve an advertising outcome.
